Terms of Service

These terms are an agreement between you and ChallengersX (“ChallengersX”, “we”, “us”). They cover your use of the ChallengersX iPhone app and our website, challengersx.com.au. By creating an account or using ChallengersX, you agree to them. If you don’t agree, please don’t use ChallengersX.

Our Privacy Policy explains how we handle your personal information.

1. Who can use ChallengersX

You must be at least 16 years old. If you are under 18, you need a parent or guardian’s permission. When you sign up, give accurate details, including your real date of birth. Keep one account per person, and don’t create an account if we have previously banned you.

2. Your account

You are responsible for everything that happens on your account and for keeping your login secure. If you think someone else has accessed your account, tell us straight away.

3. Challenges and fair play

ChallengersX works because people play fair. Log sessions honestly, and only submit proof photos and videos that genuinely show your own activity. We may adjust scores, void results or remove content where we believe someone has cheated or misused the scoring system.

4. Friendly stakes

Stakes are friendly, non-monetary forfeits, like “loser buys the coffee”. Stakes involving money, cash equivalents, gift cards, cryptocurrency, betting or wagering are not allowed. ChallengersX is not a gambling service. We never hold, transfer or enforce stakes. Any stake is an informal arrangement between the players involved.

5. Premium subscriptions

• Some features need a paid Premium subscription.
• Prices and billing periods are shown before you buy. Subscriptions renew automatically at the same price until you cancel.
• Bought in the iPhone app: Premium is an App Store subscription, charged to your Apple ID. It renews unless you turn off auto-renew at least 24 hours before the current period ends. You can manage or cancel it in your App Store account settings. Deleting your ChallengersX account does not cancel it. Refunds are handled by Apple under its policies. Apple’s Licensed Application End User License Agreement also applies to the app.
• Bought on our website: payments are handled on Chargebee’s secure hosted checkout and processed by Stripe. Deleting your account cancels a website subscription immediately.
• Payments are not refundable, except where these terms say otherwise or where the law, including the Australian Consumer Law, requires a refund.

6. Your content

You keep ownership of the photos, videos, messages and other content you submit. By submitting content, you give ChallengersX a non-exclusive, royalty-free licence to store it, process it and display it to the people who can see it under our Privacy Policy, so that the app can work. The licence ends when the content is deleted.

You must have the right to share everything you upload. Don’t upload images of other people without their permission. We may remove any content that breaks these terms.

7. Acceptable use: zero tolerance

You must not use ChallengersX to post, send or share content that:

• harasses, bullies, threatens, intimidates, stalks or demeans anyone, including through body-shaming;
• is hateful or discriminatory, for example on the basis of race, ethnicity, religion, gender, sexual orientation, disability or age;
• is sexually explicit, pornographic or contains nudity;
• sexualises or endangers minors in any way (we report this to the authorities);
• is violent or graphic, or encourages self-harm, eating disorders or dangerous training practices;
• promotes illegal activity, drugs or weapons;
• is spam, a scam, or advertising;
• impersonates someone, or shares another person’s private information;
• infringes someone else’s copyright, trademark or other rights.

You also must not:

• cheat, or falsify sessions or proof;
• set money or gambling stakes;
• use ChallengersX to contact people who have made it clear they don’t want contact;
• create accounts to get around a suspension or ban;
• scrape, reverse-engineer, overload or interfere with the service, or try to access data you aren’t allowed to see.

8. Reporting and moderation

To report objectionable content or an abusive user, email support@challengersx.com.au. Include:

• the person’s display name;
• the challenge involved;
• what happened (screenshots help).

We review every report and act on it within 24 hours. Where content breaks these terms, we remove it and suspend or ban the user responsible. We may tell you the outcome, but we don’t always share details about action taken against another account.

You can also limit who can reach you. You can remove friends, decline challenge invitations and turn off “discoverable” so that nearby players can’t see your card. If you are ever in danger, contact the police (000 in Australia).

9. Health and safety

ChallengersX is a fitness motivation app. It is not medical advice. Exercise carries a risk of injury, so:

• train within your limits;
• talk to a doctor or qualified professional before starting a new exercise programme or changing your weight significantly;
• stop if you feel pain or unwell;
• if you meet someone from ChallengersX in person, meet in a public place and tell someone where you’re going.

You take part in challenges at your own risk.

10. Apple Health

Connecting Apple Health is optional, and ChallengersX only reads workouts that you choose to import. See our Privacy Policy for details.

11. Suspension and termination

You can stop using ChallengersX and delete your account at any time from the Profile tab. We may suspend or terminate your account, or remove content, if you break these terms, if the law requires it, or if we reasonably need to in order to protect other users or ChallengersX.

12. Changes to the service

ChallengersX is under active development. Features may change, be added or be removed. We may also suspend or discontinue the service. If that significantly affects a paid subscription, we will tell you in advance where we can.

13. Our intellectual property

The ChallengersX app, website, name and branding belong to us. We give you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, for your own non-commercial use, in line with these terms and the App Store’s Usage Rules.

14. Apple

These terms are between you and ChallengersX, not Apple.

• Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it.
• If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• Apple is not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.

15. Consumer law and liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law, that can’t lawfully be excluded.

To the extent the law allows, ChallengersX is provided “as is”. Our liability for a failure to meet a consumer guarantee is limited to supplying the service again, or paying the cost of having it supplied again. We are not liable for indirect or consequential loss, or for the conduct of other users.

16. Governing law

These terms are governed by the laws in force in Australia. You and we submit to the non-exclusive jurisdiction of the Australian courts.

17. Changes to these terms

We may update these terms. We will post the new version here and update the “Last updated” date. If a change is significant, we will also let you know in the app or by email. If you keep using ChallengersX after a change takes effect, you accept the updated terms.
